No you can't sue them. I'm pretty sure the most you could do is report them to the FDA. Even if you could sue them, you would be going up against top corporate lawyers. Your only chance of winning would be to get a class action suit going, and if you won you might get a check for $10 or something.
From what I understand, cereals currently market themselves like supplements, where they can make vague claims but they can't claim that they actually cure any diseases. One cereal did make such a claim, and the FDA gave them a warning letter telling them to either stop making that claim, or submit to having the cereal regulated as a drug.
